payroll is number two on the priority list for unsecured debts in bankruptcy. Taxes due are number one. banks and trade creditors are after you.

the bankruptcy trustee will handle this, if and after he determines there is sufficient cash to pay both the taxes and you.

it’ll take a while … maybe several months.

you should receive forms from the Trustee — make sure you do, fill them out, and send them back in.

fyi … commissions due are not as secure as you’d be fond of to reckon. every bankrupt company i’ve ever dealt including or in this area has had a rash of sales restore claims and a sales restore usually earnings no commission is due for including the intention of deal.

sharks among the buyers who don’t need the products immediately make the restore claims, sometimes on flimsy excuses, in the hope of life capable to buy the product from the Trustee later for much less during the “going out of business deal”.

Question by Joe B: Why does filing bankruptcy override court judgments, why does the law allow this?

For model, a plaintiff wins in tiny claims and the defendant records for bankruptcy. As I know their line up is wiped sterile and no longer owe the judgement, how is this justified?
Obviously it’s a cop out, but why does the law allow it, what’s the laws explanation for allowing this?
Why can someone file bankruptcy and still owe outcome support but not owe a court order judgment?

Question by Rhonda S: As do garnishments bring to a standstill after filing bankruptcy?
We filed bankruptcy and on of the cerditors continues to garnish my account. So everytime I get my pay packet direct deposited it’s dead. What should I do?
I am filing PRO SE. I don’t be inflicted including a attorney because I didn’t be inflicted including 1500.00 to save one. I be inflicted including called several law offices but attorneys don’t seem to ever be in the office. I already turned in all my paperwork and my case hand said my paperwork was all there and looked fantastic. I just don’t know how to bring to a standstill the garnishments.

Q&A: When filing bankruptcy forms is it necessary to list the title of every single book and cd I own?

November 19th, 2011 Comments off

Question by Meliscious: As filing bankruptcy forms is it de rigueur to list the title of every release book and cd I own?
I know they want to know in this area every possession, but is “102 novels and textbooks” an acceptable resolution?

Best resolution:

Resolution by Common
Commonly, they are NOT looking for you to name every book and CD. The exception is everywhere those bits and pieces are of a higher than average value. For model, is one of your books a initially journal Walt Whitman? Including the intention of desires to be listed separately. The use copy of the latest Tom Clancy you got at the second hand book store? Doesn’t normally matter. So long as you’re accurately representing the value, including the intention of’s all they are normally looking for. They want to be sure you don’t be inflicted including whatever business of high value including the intention of can be sold to pay your creditors.

Now, its obviously a skilled thought to work including an attorney on this. If you can’t afford a bankruptcy attorney, you need to look nearly the town everywhere you live and see if any of them offer “bankruptcy clinics” – commonly, you pay a greatly reduced fee to go there and fill out the paperwork by physically, but including input by the attorney. It would be worth it to make sure including the intention of you are filling out the forms in accordance including your local BK court’s standards.

November 16th, 2011 Comments off

Question by rockabilly 1: My in laws are filing bankruptcy and are deciding to let their house go into foreclosure after the bankruptcy.?
Are there any repercussions? Will they own on the house, they are not including it in the BK?

Best resolution:

Resolution by Rambo
The house will be built-in in the bankruptcy by the side of including the surplus of the debts. The release way to keep a house in bankruptcy is to get the payments up to date and take up again to pay on it. You can’t exempt it from the bankruptcy.
