Q&A: I have taken out bankruptcy on a debt. The creditor is trying to sue me now?

Question by To Breathe, To Feel, To Know Im Alive: I have taken out bankruptcy on a debt. The creditor is trying to sue me now?
1 year ago I took out chapter 7 bankruptcy. The creditor never contested the debt and it was settled in the chapter 7. Now he is trying to get my mom to pay him and sent her a letter in the mail saying he would sue in 10 days if the debt is not paid. Can he do this?

If my mom does pay is that a violation of federal law and could my bankruptcy case be opened back up in federal court?

This is a scumbag tactic. He is preying on her emotions.

    If it’s your debt you are safe. There is nothing he can do with your mother.

    No send him a copy of your discharge and warn him not to contact you or your mother. Unless her name was on the loan/credit card or whatever, he has no right to call her.

    He’s trying, but he isn’t entitled to a dime. BTW, why haven’t you called him and told him to get off your mom’s back and then stick that “debt” up his a**?
