Ok before you think something bad let me explain. He had consensual sex with a minor who turned out to get pregnant. Then at 6 months pregnant told her mother she was raped. My brother was 22 and she was one week from 16. The girl would sleep with anyone and her mom thought she was an innocent little angel. My brother was charged with child molestation and is now is prison. The girls mother took care of the Judges mother as her care taker. And my brother court appointed lawyer turned out to be the judges ex husband..conflict of interest? Now he is not allowed to see his nieces or his son who all love him dearly. He has to register when he gets out and be labeled as a baby raper. I live in a small town where if you don’t have money than you do not have a chance. Now his wife sent him the divorce papers and wants full custody of their son so when he gets out, he will only get to see him once a month supervised at the court house. His son loves him and my brother lives for his little boy. My mom has been raising him, and his mom is always leaving him where ever she can and partying. She does drugs and if we call defax she will give my nephew to her parents. The girl my brother slept with was his wife’s sister. At the time they were not married but dating and both seeing other people. That’s why her parents have hated my brother for many years and will not stop until he is dead. What options are there? What can I do? I thought about that pre-paid legal, but it doesn’t seen lagitamate. I live in Georgia. I don’t have the money for a lawyer. Its not fair. Can someone please give me advice on this situation?
And for Pandora’s Box – YOU CAN”T RAPE THE WILLING! My brother is not a rapist he slept with a slut and was wrongly accused. Yes he shouldn’t have because of her age but she shouldn’t have laid it on him either.

Your brother is a rapist and he has to live with his crime. If he had sex with a 15 year old girl, he is a rapist. It doesn’t matter if his lawyer is Daffy Duck.

I know his your brother and you love him but what he did was illegal and immoral, of course his in-laws don’t like him. Whether she was raped or not it was illegal. It sounds like there are many problems with your brother, so maybe his son would be better off living somewhere safer. I feel sorry for you that this is affecting you so much but we all have to live with the consequences of our actions.
sorry but your adult brother should have known better than to sleep with a 15 year old. of course the girl is a terrible mother, she’s a kid.
1) Contact your Representative in the state legislature for advice and possible further contacts. If you can prove bias was a factor in the case, with the lawyer being the judges ex-husband and all, you might have a shot at expunging the record.

Your brother made some really bad, and illegal, and immoral choices. While you brother may have changed (or maybe not, you didn’t say), the law has to right to try to protect other 15-almost-16-year-olds from him. Even ones that would sleep with anyone.
Unless society, or the law, or both, changes radically, he is stuck with his sex offender situation, and will have to learn to live with it. It is not the end of the world (but it may be the end of a certain type of fun for him.)
It sounds like there are serious conflicts of interest here. Maybe he needs to appeal his conviction? You might find some help here: http://www.legalaid-ga.org/GA/index.cfm
First, whittle down your story to the important stuff, judges’s mother’s care-giver, court appointed attorney, leave out “hates him til he’s dead” stuff. Focus on finding reasons to ask the court to hear an appeal, not the custody or divorce stuff. This is going to take a LOT of patience.
