I get paid under W2 and they already take taxes off my tips and on top they are taking 2% which I think is for credit card service fees. Is that legal?

Your situation sounds like it is not ethical. Unless it is only tips that are on the credit card.

    Are you sure it’s service fees? It is more likely you are being taxed on credit card tips. They are reported 100% of the time for tax purposes.

    Some of them provide much less service fees.
