Question by Keith: I have a question for an attorney about the legality of an employer policy?
This employer has a policy of not allowing employee’s who would like to have their paycheck directly deposited into an online banking institution that uses prepaid credit cards. Is this legal?
Okay, my question needed more details, the company has a direct deposit program, but are restricting it as stated earlier. The bank is FDIC insured and exists offline.

I think the bigger question is why you insist on having your money deposited into one of these shady online banks, and not into a traditional brick and mortar. Do you have something to hide?

    Certainly not ILLEGAL.

They offer direct deposit as a service… it isn’t required of them. As to their policies with Direct Deposit… that is completely up to the company.

If they were refusing to pay you altogether then you’d have a case… but you have no more right to demand that they direct deposit into your online bank, pre-paid credit card than you have to demand that they pay you in gold bulleon from a Spanish galleon…. or demand they pay ou in live chickens. It’s up to them.

As long as they pay you on time and in full… then HOW they pay you is up to them

Your question is strangely prefaced, but if I understand it…sure. Basically, they can pay you however they want.

It is the businesses choice. many now require direct deposit into a checking account opened by the employee. Going with an online, credit card company is too shady and could cause the employer problems.

His only obligation is simply to pay you.
