Question by snowbeardvc: Good ol’Boy system still alive well, rural AZ. How does one get legal help, traffic ticket in kangaroo court?
Am being denied legal counsel representation by the State, on a phoney traffic ticket. Unable to afford to hire an attorney to fight it in the local kangaroo court. Does anyone have any suggestions on where I might get some help? Have sought help from this same court in past and found I was the WRONG religion, so the whole proceedure was a joke on me. So IF you have thoughts that might help me PLEASE pass them this way. This Toonerville Police Dept. has a fine record of selective law enforcement and a lack of solving crime when it affects the poorer side of the community. Everything is ALWAYS “Under investigation” but am still waiting to hear of a solved case. You have heard stories about these sorts of places, they are NOT in the past, but are still alive and well in this day and age. Can really use your help. Sorry I’m not rich enough to hire an attorney on my own, so I would not have to bother you with my problem. Thanks for suggestions or help.
It was aledged speeding…. I was doing 41 in a 40 and cop said I was doing 61….. they do not have radar it was supposed to be a paced clock…. at NO time was I paced I was watching him the whole time in my mirrors… he was accelerating on me the whole time…. watched him for over half mile…. was told that they were NOT seeking Jail time so unable to get representation, unless I pay…. have NO money… it is just a small town tax collection method.

41 was speedo read… actual was probably 39…. as for others yes we are now working together to try to change things. another note I have been denied a speedy trial, State keeps continuing this alledged offense happened on Christmas night…. (Merry Christmas huh)…

what was the ticket for? Are you SURE it’s a bogus ticket, were you speeding, not signaling, etc? Usually, even in Hickville, etc., cops are held to a pretty high standard, there. I’d re-read the ticket and really think on it. Don’t just be biased, make SURE you were doing right. If not, then fess up, and pay the ticket.

I read your addition to the original, if I was you I’d pay the ticket…then MOVE. Or, just avoid that town from now on. Pay it, under protest, then take the whole thing and mail it to the state atty. general, let them deal with it…

    EVERYONE who is accused has the right to legal counsel. If you were arrested and can not afford and attorney the COURT will provide one to you free of charge. If your rights are be violated contact the Attorney General’s office in your state. Don’t put up with bullsh*t. You have rights, use them!

    Actually, the right to be provided free counsel generally doesn’t apply to mere ordinance violations. So if this is just a speeding ticket or something similar you don’t have such a right.

    I second the advice, already given, that you think long and hard about whether you actually committed the offense charged.

    Let me guess, you live somewhere near Globe right? That’s where they have more cops than people. Trainee cops, Miami cops, Globe cops, Highway Patrol cops, Border Patrol cops

    Without knowing the county you are in I cannot give you any referrals, however there are legal aid groups throughout Arizona (and the country).

    In most jurisdicitions a court appointed attorney is not applicable to misdemeanors. If you want, however, contact you local court and see if you can get an agency number for you to contact. If nothing else, be sure to ask the judge to state clearly the possible consequences before you plea.

    As for proving the officer wrong, good luck. The only thing I know of is to be sure the calibration test was done on the equipment and that the officer is certified on that paticular radar detection device.

    Naturally, be sure to go to court. If not, you might be calling me from jail.

    The right to counsel is for serious crimes only. In general, any offense which would subject one to jail time of more than 30 days requires one to be appointed counsel. Some states have enlarged that to mandate counsel if the offense could be punished by jail time. Doing 61 in a 40 zone is not punishable by jail time. You don’t get appointed counsel.

    You could possibly call around to see if someone will do it for you pro bono. Times are hard, so your search will be long!
