Question by java: Do I have a case for fraud if my former partner declares bankruptcy?
My former partner has defaulted on our contractual agreement in which he is required to pay me $ 35,000. He put up collateral but sold and/or damaged some of it. He has filed bankruptcy because he has no money. Is his selling and/or damaging collateral give me a case for fraud so that he can be forced to eventually pay me what he owes?

You have to prove that he sold/damaged the asset knowingly to defraud you of money.
