I sold someone an XBOX 360 HD DVD player for about $ 75 on Ebay. This was in February and it is now April (for refund, I stated the item be shipped back in 7 days). I painted the HD DVD player black and this was said in the auction. Not a perfect paint job but it looked very good considering the material the HD DVD player is made of. After he received it he said “Piece of sh*t paintjob,give me my money back”. In my auction I said satisfaction guaranteed but he was extremely rude and I said no refund. He opened a paypal claim and they sided with me. Now he continues to threaten me with a court case and uses expressions like LMAO. I saw from his feedback that he’s done this before. He says he has Prepaid legal and friends in different states. He lives in Oklahoma and I live in Florida. I think he wants his money back because blu-ray won the format war and you can buy that HD player for $ 50 now. Does anyone think I have anything to worry about or is he just trying to intimidate me.

If paypal sided with you, don’t worry about it. You have nothing to worry about. It is now all a matter of him getting banned from Ebay! Have a nice day.

If you were as honest as you say, I don’t think you have anything to worry about. You stated it was painted in the auction, and sorry but buyer beware.
He is just trying to intimidate you. If he wants to sue you, he can. However, he will have to prove fraud, which is a high hurdle. The facts work against him. He received an item, and didn’t like it after. He wanted to return it for reasons that were stated in the auction. You were not deceptive in that aspect.
He probably won’t sue, and is just full of hot air. It costs a lot more than $ 75 to hire a lawyer to make a case. He could take you to small claims court, but just provide a copy of the auction listing, and paypal siding with you. He’ll have a very high hurdle to overcome.

eBay has written their policies in a very legal way, and it sounds like you made it clear when the sale was completed that the XBOX was in the condition that you said it was in. You can sue people in other states, but it would be a waste of time and money to attempt to sue you. Make sure and keep all the records of everything that has happened, like taking a screen shot of the eBay listing, if it is still there, and PayPal siding with you. If this person keeps it up, and you keep records of everything and he actually tries to sue you, you should sue back for harassment.
