If you are so sure that the US economy will collapse, you better start buying insurance against the US going bankrupt. The 5 year CDS for US soverign risk is currently trading in the open market at 36.9 basis points. This means you pay 36.9 cents for 1000$ . Sounds like a good deal to me!

Unfortunately this low CDS spread shows that the capitalist free market does not believe that the US is going bankrupt. But, hey, who believes in a free market anyway!

The client has two debtors. One is BOA (three credit cards) and one hospital bill. Fairly simple are straight forward.

She was quoted $ 1500.00. Is this price in line with what other lawyers would charge for this service?

Sound about right, I paid $ 1100 in Utah for chr 7 which is usually cheaper. Now she needs to understand she will have to pay every extra penny she makes to the courts for 3-5 years to pay off these bills. THat means no savings account, no parties, nothing at all except the basic bills rent, electric, phone, and food. They courts may tell her she needs to get rid of cell phone or other frivolous items.

There is actually a new formula since 2005, which is quite complicated. If you are eligible, you can file chapter 7 and discharge your debts. If not, you need to file chapter 13, and organize a repayment plan. To see if you are eligible for chapter 7, use the link below.

Sounds like a strange question however I am wondering if in Canada (Ontario specifically) – if a person was to declare personal bankruptcy, can this information be found out from official sources? For example, if a not-for-profit Charity has a clause that its Senior Directors can not be in office if they have declared personal bankruptcy, and one has a “thought” that one of the directors is in this situation but he does not want to reveal this fact for personal reasons, is there a source one can go to find out if the person has claimed bankruptcy?

Absolutely it is public information. If you seek to have your debts absolved, you can’t expect to do so privately.

Yes, in both the USA and Canada … medical bills are eradicated as a result of the debtor filing for bankruptcy.

We were paid some yesterday, but not all that is due. What are the options we have for getting money due including un-paid commissions.

payroll is number two on the priority list for unsecured debts in bankruptcy. Taxes due are number one. banks and trade creditors are after you.

the bankruptcy trustee will handle this, if and after he determines there is sufficient cash to pay both the taxes and you.

it’ll take a while … possibly several months.

you should receive forms from the Trustee — make sure you do, fill them out, and send them back in.

fyi … commissions due are not as secure as you’d like to think. every bankrupt company i’ve ever dealt with or about has had a rash of sales return claims and a sales return usually means no commission is due for that sale.

sharks among the buyers who don’t need the products immediately make the return claims, sometimes on flimsy excuses, in the hope of being able to buy the product from the Trustee later for much less during the “going out of business sale”.

I understand bankruptcy, I am specifically asking, is it normal that no action is taken by the military or is it more the norm that they will nail the enlisted person who is filing, looks like you are saying it is not normally a big deal as far as military career goes, is that right?

While Soldiers may not be punished for declaring bankruptcy in good faith, they may face administrative consequences or UCMJ action if they dishonorably fail to pay just debts. There may also be adverse actions to a security clearance or position of trust that you hold with the military.

Having a bankruptcy on your credit report may limit your post-military employment choices. Companies that deal in financial transactions typically require their employees to be “bondable.” With a recent bankruptcy, you will be unable to qualify for such a position.

What other options do I have? Bankruptcy should be a choice of last resort. You should strongly consider taking one or more of the following steps before filing bankruptcy.
